Opening the round table discussion, N.Korolevska, Committee Chairman, stated that "the mechanism of state-private partnership provides for attraction of investments, protecting the state from the possible raider attacks of private investors." The People´s Deputy deems necessary to adopt the law on the state-private partnership, since such a mechanism of attracting investments into the objects of infrastructure is proven in the majority of European states.

 

The drafted bill sets legal, economic and organizational principles of cooperation between the state and private partners, regulates relations connected with drafting, implementation and termination of agreements concluded in the framework of the state-private partnership, sets the guarantees of observance of rights and legitimate interests of the contractual parties.     

 

For the implementation of the state-private partnership, the agreements on concession, joint activity agreements, production-sharing contracts, and other agreements shall be concluded.   

 

The attendants of the round table discussion believe that the state-private partnership shall become the ideology of cooperation between the state and business, and should be considered not only as an investment mechanism, but also as an effective model of economic administration that curtails budget expenditures and increases the quality of infrastructure management.

 

The reporters suppose that merger of motivations of state and private sectors, as well as conclusion of contracts on a competitive basis, extend the possibilities for employing innovative approaches for the implementation of state infrastructure projects.

 

In the result of the discussion, the participants recommend that The Verkhovna Rada facilitates scrutiny and adoption of the bill "On Fundamentals of Cooperation between the State and Private Partners". The People´s Deputies believe that the Cabinet of Ministers shall found an institutional centre of state-private partnership development in Ukraine.
